Welcome to Deseo Absoluto. By accessing or using our website deseo-absoluto.com and purchasing our products, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our services. These Terms are governed by United Kingdom consumer protection law, including the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Protection from Unfair Trading Regulations 2008 and the Electronic Commerce (EC Directive) Regulations 2002.

1. Acceptance of Terms

By accessing our Site and/or purchasing from us, you confirm that you are at least 18 years of age, and that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Return & Refund Policy. If you do not agree to these Terms, please do not use our services.

3. Products and Services

We reserve the right to modify, suspend, or discontinue any product or service at any time. Where this affects an order you have already placed, we will contact you and offer you a full refund.

All product descriptions, images, and specifications are provided in good faith and are as accurate as possible. We reserve the right to correct any errors, inaccuracies, or omissions. Colours may vary slightly due to monitor settings.

4. Pricing and Payment

All prices are displayed in the applicable currency and include Value Added Tax (VAT) where applicable. Shipping costs are additional and will be clearly indicated before you complete your purchase.

We reserve the right to change prices at any time, but changes will not affect orders already accepted. In the event of an obvious pricing error, we will contact you and give you the option to proceed at the correct price or cancel your order.

We accept payment via the methods displayed at checkout. All payments are processed securely by our payment providers. We do not store your full payment card details.

5. Order Processing and Confirmation

After placing an order, you will receive an order confirmation email. This email constitutes acknowledgement of your order, not acceptance. A contract between you and us is formed when we despatch the goods and send you a shipping confirmation. We reserve the right to refuse or cancel any order for reasons including product unavailability, obvious pricing errors, or suspected fraudulent activity. Where we cancel an order for which you have already paid, we will refund you in full.

6. Delivery

We aim to deliver within the timeframes stated on our website. Unless we have agreed a specific delivery date with you, we will deliver your goods without undue delay and in any event within 30 days of the contract being formed, in accordance with the Consumer Rights Act 2015.

7. Your Consumer Rights

If you are a consumer, you have the right to cancel your purchase within 14 calendar days of receiving the goods, without giving any reason. For full details of your return rights, please see our Return & Refund Policy, which forms part of these Terms.

Under the Consumer Rights Act 2015, goods supplied to you must be of satisfactory quality, fit for purpose and as described. If they are not, you may be entitled to a refund, repair, replacement or price reduction depending on the circumstances and on when the fault appears. These rights are set out in more detail in our Return & Refund Policy. Nothing in these Terms affects your statutory rights.

8. Prohibited Uses

You agree not to use our Site or services for any unlawful purpose, to solicit others to perform unlawful acts, to violate any applicable regulations, or to infringe our intellectual property rights or those of third parties.

9. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of Deseo Absoluto or its content suppliers and is protected by the Copyright, Designs and Patents Act 1988 and other applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Limitation of Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or of our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the goods, or for any other liability that cannot be limited or excluded under English law.

Where you are a consumer, we do not exclude liability for defective products under the Consumer Protection Act 1987.

We supply the goods for domestic and private use. If you use them for any commercial or business purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Our Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

12. Complaints and Dispute Resolution

If we are unable to resolve your complaint to your satisfaction, you may wish to use an Alternative Dispute Resolution (ADR) scheme. A list of approved ADR bodies is available from the Chartered Trading Standards Institute at ctsi.org.uk. Free and impartial advice is also available from the Citizens Advice consumer service.

We are not obliged to participate in alternative dispute resolution proceedings, but we will make reasonable efforts to resolve any dispute amicably. Using an ADR scheme does not affect your right to bring court proceedings.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, and you may bring proceedings in the courts of England and Wales. If you live in Scotland, you may also bring proceedings in Scotland; if you live in Northern Ireland, you may also bring proceedings in Northern Ireland. Nothing in this clause affects any mandatory consumer protection rights available to you in your country of residence.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. The Terms that apply to your order are those in force at the time you place it; changes will not apply retrospectively to orders already accepted.
